Q : What should I do? Foreigner who has been granted to stay in Thailand with Non-Immigrant Visa-B, but doesn't have Work Permit!
A : Foreigner can cantact and consult with Department of Employment about Applying for Work Permit. There are rules and regulations about Workd Permit for foreigners, please go to www.doe.go.th for more information. Please urgent apply for Work Permit (W.P.1) at Department of Employment before start working. If foreigner works without Work Permit, he'll be prosecuted by laws.
Q : What should I do? If Work Permit is about to expire (within or less than 30 days), but the required documents are incomplete. Or Foreigner doesn't stay in Thailand during Work Permit is about to expire.
A : Foreigner must notify to resign from his work within 15 days after his Work Permit has expired. In case of delay notification
more than 15 days, A fine will be applied for both employer and foreigner.
Remarks: If foreigner cannot certify Original Work Permit, he is unable to apply the renew in all cases. (Exception in case of lost)
Q : How long is Work Permit valid?
A : The duration of Work Permit will be considered as appropriate. The officer will issue Work Permit for duration of 3 months,
6 months, 1 year or maximum 2 years each time. And the validity of Work Permit may not be covered with the visa or the
Permit of stay in Thailand.
Q : How do I renew my Work Permit? Can I renew my Work Permit which is already expired?
A : Foreigner or Attorney must renew to extend his stay in Thailand (Non-B Visa) from the Immigration Bureau prior to the
expiration of the permit term with Form W.P.5. If Work Permit has already expired or foreigner delays to renew within the period, it means that his Work Permit cannot be renewed. Foreigner must submit new application for Work Permit by apply with form W.P.1.
During apply for Work Permit, he must hold the valid "Non-Immigrant Visa-B".
Q : Qaulification of foreigner who is eligible to apply for Work Permit in Thailand?
A :
- Foreigner who has Permanent Residence in Thailand or has been granted for Non-Immigrant Visa, not Tourist or Transit
Visa.
- Foreigner who has knowledge and ability of work.
- Foreigner is not insane or mentally sick, not suffer from Leprosy, Tuberculosis, Elephatitus and Tertiary Syphilis,
Drug Addiction or Alcoholism.
- Foreigner who never been sentenced to imprisonment for offenses under Immigration Laws or the laws of on working of
foreigners 1 year prior to the date of applying for a permit.
Q : What should I do If Work Permit is lost, stolen or damaged?
A : Foreigner must apply for the a Substitue Permit (W.P.4) within 15 days from the date of the knowledge of such damage or
loss and before expiry date. Foreigner or Attorney can submit the application with completed documents, obtain a Substitue Permit will be issued within 3 working days. For new issued Work Permit, foreigner must show up to certify on the date of receive.
Q : What should I do if I would like to change my job in Thailand?
A : There are 2 processes for foreigner.
- Foreigner must contact the local Employment Office where his organization is located to notify his termination of work.
The Employment Office will issue Employment Termination Letter and foreigner must submit this letter to certify to
The Immigration Bureau for visa and the permit to extend stay in Thailand for 7 days. Foreigner must urgent submit Form WP.25 (Work Permit Application and Renewal Application Form for a foreigner under Section 59). After receiving new Work Permit, foreigner must continue submiting for Non-Immigrant-B Visa before the expirition date.
- Foreigner must leave Thailand to submit his new Non-Immigration-B at Royal Thai Embassy or Thai Consulate at his own
country and his new employer must process for WP.32 (Work Permit Application Form for application made on behalf of
a foreigner pursuant to Section 60 Clause 2) After receiving WP.32, new employer must send Original WP.32 to foreigner for submit application form for Non-Immigrant-B Visa at Royal Thai Embassy in his own country. When his visa is already granted, foreigner can enter to Thailand and he must continue submit for his Work Permit within 30 days and must renew his Work Permit before expirition date.
Q : What kind of career and title that foreigner can submit for his Work Permit at the local Employment Office?
A : The occupations for foreigner must not be "Prohibited Occupations" and must not be a Specific Position such as Engineer,

Q : Where should foreigner submit for Work Permit if he is Specific Duty?
A : Foreigner who performs for Specific Duty must submit his application at One Stop Service Center for Visa and Work Permit OSS) Located at Chamchuri Square Building or Royal Thai Embassy / Thai Consulate. Thus the Orgnaization of employer must approve the occupation of foreigner in BOI system in prior, then foreigner can continue submitting for his Work Permit and Non-Immigrant-B Visa.
